Introduction
Welcome to The Self-Kindness Company Inc. (“we”, “our”, or “us”). We offer mindset-first, emotional wellness-based support services through guided group coaching programs designed to complement medical, fitness, or lifestyle journeys - not to replace them. These Terms of Service (“Agreement”) govern your access to and use of our programs, content, websites, and communication platforms (collectively, the “Platform”).
By accessing or using the Platform, you agree to be bound by this Agreement and our Privacy Policy. If you do not agree, please do not use the Platform.
Program Services
We provide non-clinical, group-based emotional support and mindset coaching through:
3-Month Introductory Program
6-Month Advanced Program
These services are not therapy, medical advice, or a substitute for professional health care. All instructors and coaches are trained facilitators with experience in emotional wellness, but they are not acting as licensed medical or mental health professionals.
You acknowledge that:
Our services are not intended to diagnose, treat, or prevent any medical or psychological condition(s)
You are responsible for seeking medical or psychological care when appropriate
Our programs are educational and coaching-based in nature
If you are experiencing a crisis or emergency, call 911 or your local emergency services.
Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to participate. By enrolling, you confirm that:
You are using the services for personal development purposes only
You are not prohibited from accessing such services under any applicable laws
Payment & Subscription
Access to our programs requires payment in full or via a subscription, depending on the offering:
3-Month Introductory Program: $689.00 CAD plus applicable taxes.
6-Month Advanced Program: In Development
Optional add-ons (e.g., private coaching, emergency calls) may incur additional fees
We reserve the right to change pricing or program structure with notice. Fees are non-refundable unless otherwise stated in writing.
Cancellations & Refunds
All purchases made through The Self-Kindness Company Inc. are final. We do not offer refunds, partial or full, for any services, subscriptions, or digital products, including but not limited to group programs, coaching sessions, or downloadable materials.
By enrolling in a program or purchasing a service, you acknowledge and agree that:
You are responsible for understanding this refund policy before completing any purchase.
You have read all relevant program information and feel confident that the service meets your needs.
Your purchase grants access to materials, intellectual property, coaching resources, and/or program content that cannot be “returned”.
Exceptions may be considered only in cases where services were not delivered as described. In such cases, The Self-Kindness Company reserves the sole right to determine eligibility for a remedy.
Your Responsibilities
You agree to:
Engage respectfully with group members and facilitators
Use the Platform and services only for lawful and personal purposes
Keep any and all of your login credentials confidential and secure
Not record, reproduce, or distribute program content without permission
Read and fully understand the program details and requirements as outlined before purchase.
Intellectual Property
All materials provided by The Self-Kindness Company Inc., including program materials, videos, handouts, content, designs, and logos, are owned by us or our licensors and protected under copyright law. You may use them for your own personal, non-commercial use only, and are not to be distributed without permission.
Disclaimer of Warranties
Our services are provided “as is” without warranties of any kind. We do not guarantee that participation will lead to any particular outcome, result, or transformation. You understand that results vary by individual and depend greatly on your level of engagement and follow-through.
Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages. Our total liability for any claim related to this Agreement shall not exceed the amount you paid for the services within the past 12 months.
Dispute Resolution & Arbitration
Binding Arbitration:
You and The Self-Kindness Company Inc. agree to resolve any dispute, claim, or controversy arising from or relating to this Agreement through final and binding arbitration in accordance with the rules of the Federal Mediation and Conciliation Service (FMCS).
Class Action Waiver:
You agree that any dispute resolution proceedings shall be conducted only on an individual basis and not in a class, consolidated, or representative action.
Opt-Out Right:
You may opt out of this arbitration clause within 30 days of accepting this Agreement by emailing jesse.merelaid@selfkindness.ca with subject line “Arbitration Opt-Out” and your full legal name.
Modifications to the Platform
We reserve the right to modify, suspend, or discontinue any part of our services at any time. We may also update these Terms from time to time. You are responsible for reviewing them periodically. Continued use of our services constitutes acceptance of any changes.
Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the province of Alberta, and applicable Canadian laws.
